Terms and conditions

1. About these terms

These terms govern your use of truenorthcables.ca (the "site") and every order you place on it. The site is operated by True North Cables Inc. ("True North Cables", "we", "us"), a Canadian business that ships from Manitoba.

By using the site or placing an order, you agree to these terms and to our privacy policy. If you do not agree, please do not use the site.

Nothing in these terms takes away any right you have under the consumer protection laws of your province or territory. If a term conflicts with those laws, the law applies instead, and the rest of these terms still apply.

2. Who can buy

You must be of the age of majority in your province or territory to place an order, or have a parent or guardian place it with you.

We currently sell to and ship to addresses in Canada only.

If you buy for a business, you confirm that you are authorised to do so. Quotes, bulk orders and purchase orders are governed by these terms unless we both sign a separate written agreement.

3. Your account

You do not need an account to order. If you create one, you sign in with a one-time code we send to your email address, so anyone who can read your email can sign in. Keep your email account secure, and tell us promptly if you think someone else has signed in to your account.

Keep your account details accurate. You can delete your account at any time under My account, Settings. Your past orders stay on file as our privacy policy describes.

We may suspend or close an account used for fraud or abuse or in breach of these terms. Any order already paid for will still be shipped or refunded.

4. Products and prices

We describe and photograph our products as accurately as we can. Specifications come from the manufacturer, and colours can look different on different screens. Please check that a product suits your equipment before you buy; if you are unsure, ask us through the contact page.

Prices are in Canadian dollars. They do not include taxes or shipping, which are shown at checkout before you pay. If your card is in another currency, your card issuer converts the amount and may charge a fee.

If a price or description on the site is clearly wrong, we will tell you before we ship and give you the choice of buying at the correct price or cancelling for a full refund.

Stock is limited. If an item turns out to be unavailable after you have paid, we will tell you and refund that item in full. We may limit the quantity of an item per order.

5. Orders and payment

Before you pay, checkout shows the items, their prices, the shipping method and cost, each tax and the total. Please check them.

We accept major credit cards, Apple Pay, Google Pay and Link, processed by Stripe. Your payment is charged when you place the order.

When your payment is approved, we email you an order confirmation with your receipt attached. That email confirms our agreement and is your copy of it; please keep it.

Every payment is screened for fraud. We may hold an order while we review it, and we may cancel an order we cannot verify, with a full refund.

Promo codes are subject to the conditions shown with them, such as a minimum order, the destinations they apply to and an expiry date. They have no cash value, one code applies per order, and we may withdraw a code at any time before an order is placed.

6. Taxes

We charge the GST, HST and provincial sales tax that apply to your shipping address, calculated at checkout. Your receipt lists each tax and our registration numbers.

Delivery to a First Nations reserve: if you declare at checkout that you are eligible for the exemption for goods delivered to a reserve and give your status card registry number or band number, no tax is charged. The order must be delivered by the carrier to the reserve address; the exemption does not apply to air cargo collected at an airport. You are responsible for the accuracy of your declaration. If it is not accurate, you are responsible for the tax that should have been charged, and we may collect it from you or cancel the order.

Resellers: once we approve a provincial tax number you file in your account settings, that province's sales tax is removed from your orders shipped there. GST or HST still applies. You are responsible for keeping the number valid and for any tax you must account for on resale.

7. Shipping and delivery

We ship from Manitoba within 1 business day of your order (Monday to Friday, excluding statutory holidays). The delivery estimate shown at checkout comes from the carrier and is an estimate, not a guarantee. We email you a tracking number when your order is on its way.

Air cargo with Calm Air, where offered, is collected by you at the airport cargo office in your community. Calm Air will call the phone number on your order when it lands; bring photo ID. Freight is prepaid.

Please check your shipping address before you pay. We can change it until the shipping label is printed. If a parcel comes back to us because the address was wrong or the parcel was refused or not collected, we will contact you to arrange a new shipment, for which you pay the shipping again, or a refund of the items.

The order is your responsibility once it is delivered to your address or, for air cargo, once you collect it. Until then, if it is lost or damaged in transit, contact us and we will replace it or refund you.

If your order has not arrived within 30 days after the delivery date estimated at checkout, you may cancel it for a full refund.

8. Cancelling an order

You can cancel an order free of charge until its shipping label is printed. Send a cancellation through the contact page with your order number as soon as you can. Once the label is printed, the order is on its way and you would need to return it instead.

We may cancel an order, with a full refund, if an item is unavailable, a price or description was clearly wrong, the payment cannot be verified, or we cannot deliver to the address given.

9. Returns and refunds

You can return unused items in their original condition and packaging within 30 days of delivery. Start a return through the contact page with your order number and the items you want to return; we will reply with where to send them. Please do not send a return without contacting us first.

You pay the cost of return shipping, unless the item arrived defective or we sent the wrong item, in which case we will cover it.

Once we receive and inspect the return, we refund the price of the returned items and the tax you paid on them to your original payment method. Original shipping charges are refunded only if the return is because of our error. Most banks show a refund within 5 to 10 business days.

We may decline a return that is used, damaged or incomplete, and will tell you why.

10. Warranty

Every product is covered for 1 year from the date of purchase against defects in materials and workmanship under normal use. The warranty does not cover physical damage, misuse, accidents, modification, normal wear, or use outside the product's specifications.

To make a claim, contact us with your order number and a description of the problem. We may ask you to return the item before we repair it, replace it or refund it; we choose which.

This warranty is in addition to the warranties and conditions that the law of your province or territory provides, such as that goods be of acceptable quality and fit for their purpose. Those cannot be excluded, and nothing in these terms limits them.

11. Using the site

You may use the site to browse, shop and manage your orders for lawful purposes. You agree not to:

  • interfere with the site's operation or security, or try to get around its rate limits or bot checks;
  • use bots, scrapers or other automated means to place orders or collect content or data from the site;
  • place fraudulent orders or give false information, including a false tax exemption declaration;
  • misuse promo codes;
  • send unlawful, abusive or harmful content through the contact form.

We may block access to the site for anyone who does.

12. Intellectual property

The content of the site, including its text, photographs, logos, design and software, belongs to True North Cables or its licensors and is protected by copyright and trademark law. The True North Cables name and logo are ours. Product and brand names of others, such as HDMI, belong to their owners.

You may view the site and print pages for your own records. Any other copying or use needs our written permission.

13. Other services

Some parts of the service are provided by others, including Stripe, Link, Apple Pay and Google Pay for payment, and carriers and Calm Air for delivery and tracking. Their own terms apply to your use of their services, and we are not responsible for their websites.

14. Our liability

This section applies to the extent the law allows. It does not limit any right you have as a consumer that the law says cannot be limited.

We work to keep the site accurate and available, but we do not promise that it will always be uninterrupted or free of errors.

We are not liable for indirect or consequential losses, such as lost profits or lost data, that were not a reasonably foreseeable result of our breach of these terms. Our total liability for any order is limited to the amount you paid for that order.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. If you are a consumer in Quebec, these limits do not apply to the extent the Consumer Protection Act (Quebec) prohibits them.

15. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, such as severe weather, carrier strikes or disruptions, flight cancellations, power or network outages, or government action. If one delays your order, we will tell you, and if the delay is long you may cancel for a full refund.

16. Changes to these terms

We may update these terms from time to time. The date at the top shows when they last changed. The terms on the site when you place an order apply to that order.

17. Governing law and disputes

If you have a problem, please contact us first; most issues can be solved quickly.

These terms are governed by the laws of Manitoba and the federal laws of Canada that apply there. Any dispute will be heard by the courts of Manitoba, but if you are a consumer living elsewhere in Canada, you may also bring a claim in the courts of your own province or territory, and its consumer protection laws continue to apply to you.

18. General

These terms, our privacy policy and the details shown at checkout make up the whole agreement between you and us about your order. If a court finds any part of these terms unenforceable, the rest still applies. If we do not enforce a term right away, we can still enforce it later. We may transfer our rights and obligations under these terms to a successor business; this will not reduce your rights.
